I currently have a Durable POA for my mother who is 91 & in a local full time healthcare facility. We had the POA done in Jan 2015. At the time my mothers drivers license was about to expire & the Real CA ID was non existent. At the time it was suggested that we didn’t need to get her a regular ID since we already had the Durable & she was in a facility. It has recently come to our attention that the POA that I have does not support changes that arise when it comes to financial banking matters. We are told that a law was passed Jan 1, 2015, that a durable must have specific wording that allows the Principal to add or remove a Owner from an account. The person who did our POA & notarized it did not include that verbiage. I am moving out of state on Aug 15th & need to get a new Durable POA with the correct verbiage so our oldest daughter can be added to bank accounts. We also need to have her as the secondary POA should something happen to me & I am unavailable or unable to may decisions regarding my mother. The other problem we have is that my mother does not currently have a photo ID. We are working on getting that from DMV on Aug 28th but she will most likely not get it before I leave. Can a POA be done with witnesses who can verify who she is? Also as a paralegal do you notarize or do I have to find a notary specifically for that? What would be the cost for this service & how soon can it be done?
