Small Claims case: Need to file a Motion to Dismiss DISTRICT COURT OF THE 5TH JUDICIAL DISTRICT OF THE STATE OF IDAHO, IN AND FOR THE COUNTY OF TWIN FALLS, SMALL CLAIMS DEPARTMENT CASE NO. CV42-17-1687 PLAINTIFF: AKRAM SABBAR ABDUL RAHMAN DEFENDANT(S) SCOTT RECORD OMEGA HOLDINGS, LLC MOTION TO DISMISS Basis: Defendant requests a summary dismissal of this Small Claims case, based on the fact that “Loan” is not an admissible cause of action Note to Freelancer: It is unclear what this lawsuit is “for”. We agreed to pay the Plaintiff interest on a loan he gave us. We paid back the loan IN FULL ($10,000.00, USD), and we also paid an additional $500.00 interest. We had a conversation about paying $1,000 interest, but nothing was in writing, and now that we have been sued, we are not inclined to pay an additional interest. The lawsuit is stats “loan” as the cause of action. I am not an attorney, so I hope that this will be sufficient to get the case dismissed prior to trial.. United States Federal Rule of Civil Procedure 12(b)(6): Failure to state a claim upon which relief can be granted; ALL I would like done, is to put the above into a Motion to Dismiss, (ONE PAGE). It should be in the format the courts allow, (numbers on the left column of each line, etc.). Since it's just Small Claims, it does not have to be perfect.
